These thoughts really dive deep into why we do what we do and how we go out there to achieve it.

What does solving problems mean in business?

Before I try answer that, let’s quickly take a look at what a problem actually means:

A matter or situation regarded as unwelcome or harmful and needing to be dealt with and overcome.

So a business problem is something your business is facing that is either unwelcome or harmful that needs to be dealt with and overcome.

In a business these problems could be something very clear like staff stealing, lack of leads or expenses that are going through the roof.

However, under the surface, there could also be instances where problems are not as easy to spot and could be extremely damaging to any business.

These could be inefficient systems/processes in place, a disjointed brand or unhappy staff. Solving problems like these are important for business to progress.

But my business doesn’t have any problems?

I’d like to challenge you here and say that if your business isn’t facing any problems then you’re not growing. Remember when you were growing up? As your body grew, certain parts struggled to keep up, so you went through growing pains.

Now that you’re an adult and have stopped growing, the pains have gone. This is how a business is. The only difference is that a business should never stop growing.

How does one find these problems?

This is often the hardest part of solving problems – finding out exactly what it is. If you’re the only person in the company, the best option would be to look at your day and find out what’s taking up your time.

If you take the 80/20 principle, you really want to spend 80% of your time on what makes you money and 20% of your time on things that don’t (things like admin and accounting, unless that’s your business).

If you find that you’re spending time on things that don’t make you money, you’re wasting a resource that you can never get back.

If you’re pretty good at managing your time then we would need to look at what we can scale to make you more profitable. Remember, you can’t increase the number of time you have (see how much that doesn’t make sense).

You can only increase how much you can get done in a certain amount of time. Look at what you repeat and do often. Also look at what you really don’t like doing that you do often (that’s always a winner from a psychological factor).

If you are fortunate enough to have multiple people working for you, the number one place you can start is by speaking to them on an individual basis or in their respective teams.

What do they spend their day doing (not micromanaging, but just an overall perspective), what do they dislike doing, what do they do over and over again and what stops them from doing their job really well.

I’m pretty sure that if you have one employee that you’d get enough information to keep you busy for a while. If you have more, the list will exponentially grow as you add layers of management and communication issues and general relational problems.

Right, I see problems, how do I solve them?

I honestly don’t need to go deep into this. Have you ever heard the saying “How do you eat an elephant? Piece by piece”. That’s how you go about solving problems in your business – one problem at a time.

One problem might solve another, or make another problem the next priority, but if you try solve them all at once then you’ll get nowhere and have even more problems.

So, really, how do I solve them?

Once you’ve found problems, you need to start prioritising them. What could you do now that would give you some results?

Once you’ve got a list, start from the top and look at ways to solve them. This is where we think technology comes to the rescue in most cases (not always, don’t be mistaken by that).

When you have a problem, you’re trying to see if you can implement a solution that will ease or remove it (validating that this solution will work) or won’t remove it (the proposed solution wouldn’t work).

For that reason, you want to make the solution focussed and require less effort to implement so that you can get that feedback as early as possible.

Feedback is pivotable to making sound business decisions. You can get feedback in many ways; like customer feedback (emotion), big picture numbers (vanity) or high measurable objectives.

We prefer putting a solution on the table and deciding what would make us consider that solution a success or not. We’re not talking about an objective like: we need to hit one million customers or I need to decrease costs.

I’m talking about objectives like: we need to increase our lead conversions to 5% so that we can double our customers on a month-to-month basis or we need to increase the efficiency of our ten admin staff by 10% so we don’t have to hire another employee. That focus allows you to really see if what you did is getting you to that goal.

What should I do when I have those objectives?

When you have those objectives, you have most likely already pinpointed where in your business you’d like to place a solution. Once you have that, you’ll have a good idea about what you’re looking for.

You can bring in a company that provides solutions (if you haven’t already – that could have been one of your solutions) or you can find software/tools that already provide a solution for what you’re trying to solve.

This is what we love so much about technology. It either provides a solution or gives you a solid foundation to build your own, which you can reliably measure against the objective you set out to achieve.

Remember, you want to identify the problem, set out a clear objective in fixing it, implement a solution (with or without technology – we prefer with) and then measure to see if it worked or not.

An unfortunate fact about the current H-1B climate is the historically high request for evidence (“RFE”) and denial rates for H-1B petitions. Government data and research by many organizations (see National Foundation for American Policy (NFAP) analysis) have shown historically high H-1B denial rates – with some first-time H-1B petitions having a denial rate of 32% compared to 6% just four years ago.

This article seeks to outline practical options and strategies for dealing with an H-1B denial and highlight the different strategies and options between cap denials and all other H-1B denials.

Understanding the Reason for Denial and Beneficiary Status Options

One of the first key steps following an H-1B denial is to understand the exact reason for the denial. USCIS adjudicators rely on boilerplate denial templates; unfortunately, and especially over recent months, adjudicators have started to issue denial decisions with little or no explanation as to the exact and specific reasons for a denial. In practical terms, a denial letter can be several pages long, with 99% of it being standard boilerplate language, including elaborate references to case precedent, but with only sentence or two of actual case-specific language.

The result is that petitioners and their attorneys are often left making educated guesses as to what may be the exact reason for a denial based on reviewing the initial filing and any RFE responses.For more information on h1b sponsorship check Orphosys Corp.

Among the more common denial reasons are specialty occupation (see our alert on this topic), end client documentation including right of control and/or availability of work at the end client worksite, and educational qualifications of the beneficiary including non-accredited/for-profit universities.

Another key aspect to analyze immediately after a denial (ideally this should have been considered prior to a denial being issued) is the beneficiary’s status options for those who are in the U.S. H-1B beneficiaries applying for their first H-1B under the annual “cap” are often on F-1 student, L-1 or L-2/H-4 dependent status and may be able to independently continue to remain in the U.S. despite the denial but some may require immediate steps such as status extensions or similar. Important Reminders about “Appeal”

We use the term “appeal” in the context of H-1B petitions to mean filing an I-290B, Notice of Appeal or Motion, seeking a Motion to Reopen or a Motion to Reconsider (“MTR”) a denial decision by USCIS. Most often this is the next step to be followed following an H-1B petition denial and the term “appeal” used in this article refers to the I-290B process.

Filing of an MTR appeal does not grant status or otherwise keep the H-1B “pending” while the appeal is pending. Only if the appeal is successful and the MTR approved (denial reversed, H-1B petition approved), then the H-1B beneficiary gets status approval often with the validity dates noted in the actual H-1B petition.

Also, an MTR appeal must be filed within 33 days of the denial decision (or 30 days if denial decision received by fax or email). This makes for a very time-sensitive process especially since an MTR appeal should ideally include a substantial brief to outline in detail why USCIS was wrong in denying the case or to provide new facts or information.

H-1B Cap Petitions – Appeal Only Choice

For denied H-1B cap petitions filing an “appeal” is the only choice (other than giving up and possibly waiting until the next H-1B cap “season”) assuming the H-1B cap has been reached and closed for the fiscal year (which has been the case for the previous many years).

When we counsel H-1B employers who have received a cap denial, after having analyzed the reasons for denial, we often emphasize that an appeal is the only viable option to try to get an H-1B cap petition approved within several months.

The alternative to wait until the following April to file a new H-1 cap petition, take chances under the random lottery and then hope for an approval with a start date of the following October 1st – this means having to wait 12, perhaps more, months for a chance for an H-1B approval.

H-1B Extensions, Amendments or Transfers – Appeal vs. Refiling

H-1B petitions seeking extension, amendment or transfer certainly can and should consider filing an appeal. But in many cases there may be a faster alternative to resolving the problem caused by the denial.

In the vast majority of cases, the H-1B beneficiary has already been counted under the H-1B cap in the past and is, therefore, cap-exempt for subsequent filings. This means that as an alternative (or in addition) to filing an appeal, the H-1B petitioner (or another employer) can consider re-submitting the H-1B petition to USCIS.

As a general matter, the fact that USCIS has denied a petition does not necessarily mean that they will deny a subsequent petition by the same employer for the same beneficiary and for the same position. Unfortunately, adjudicators vary in their (often subjective) reading of a case and a refilling should ideally be supported by more extensive, new, better prepared or presented or otherwise improved documentation.

A refilling of an H-1B petition is a substantially faster way to get a decision by USCIS compared to an appeal. An MTR appeal can take easily between 3-6 and sometimes upward to 12 months while a refilling of an H-1B petition can take 15 days for a decision when premium processing is elected and paid for.To know more details on  jobs for h1b visa holders visit Planetm

We understand that it is tempting to appeal a case where there is a clear government error, but in terms of solving the immediate problem and getting the H-1B petition approved, a refilling is often the faster way.

In some cases a denial decision leaves the H-1B beneficiary without status – for example, H-1B extension where the denial is issued after the beneficiary’s petition and I-94 have expired. In such cases it is possible to refile a petition and ask the government to issue an approval with retroactive effective date (nunc pro tunc) which, if successful, would put an H-1B worker back in status.

This works best for refilings done as result of extension with the same employer but it is also doable for H-1B transfer as well . This approach allows the possibility of “fixing” an H-1B worker’s status without having to leave the U.S. but it has to be done quickly and very carefully to avoid issues such as overstaying I-94 (unlawful presence of more than 180 days means ban on entering the U.S.). Mechanics, Timeline and Chances of an “Appeal”

As noted above, the MTR appeal must be filed very soon after USCIS issues a denial – often within 30 or 33 days after the denial decision. The MTR filing requires Form I-290B together with fee and should be ideally accompanied by a legal brief.

A motion to reconsider must state new facts to be supported by documentation and a motion to reopen must state specifically the reasons for reconsideration and be supported by relevant legal precedent decisions to establish that USCIS was wrong.

As a result, an appeal must specifically address either or both of these points and provide clear explanations as to the new facts or the misapplication of the law. Not doing so will cause the MTR appeal to be simply denied as not meeting the MTR requirements. This makes it important to include a legal brief specifically explaining how and why the denial was incorrect.

Once the MTR appeal is filed, the case is eventually transferred to the service center which issued the denial decision and the appeal is often reviewed by the same officer (or unit) which issued the denial in the first place.

As a result, it is important to prepare the MTR appeal in the best possible way in order to change the adjudicator’s mind and to convince them that they were wrong. This is often a fairly high bar.

Our recent experience indicates that an MTR appeal takes 3-6 and sometimes up to 12 months to get a decision from USCIS. As noted earlier in this article, the filing of MTR appeal does not normally grant status or continuing work authorization (as if H-1B is pending) while the MTR appeal is pending so employers and beneficiaries should understand that.

Only in the event the MTR appeal is successful and the H-1B petition granted, then the candidate would normally be granted status for the term requested in the H-1B petition.

Our clients always ask us what are the chances of success during MTR appeal. Unfortunately, this is an extremely case-specific question and even then, it is hard to predict whether the USCIS adjudicator will change their mind.

However, by the time an H-1B denial is issued, there is often substantial case documentation on record (H-1B petition, RFE notice, RFE response, denial decision) and we are generally able to identify and focus on the key factors for approval.

The dramatic increase in denial rates for H-1B petitions without substantive change in the rules and regulations means that there are many (thousands) of H-1B denial decisions which are incorrect and can or should be appealed.

The suitability of an MTR appeal varies between types of cases and personal situations but we have found that many employers (especially for cap cases) should at least evaluate and consider the MTR appeal option.

Datsun India has updated its entry-level redi-GO hatchback with additional features for the model year 2019. The updated redi-GO is priced at a premium of about ₹ 7000 over the current version that starts at ₹ 2.68 lakh (ex-showroom, India). The new model adds both safety and convenience features without any changes to the mechanicals. The 2019 Datsun redi-GO gets ABS across all variants, while the driver side airbag is offered only on the range-topping trim. Expect the driver side airbag to be made standard soon though, while features like seatbelt reminder, high-speed warning and rear parking sensors could be added soon.

The 2019 Datsun redi-GO’s lower trims – T, T(O) and S – get central locking with remote lock, while the A variant gets power steering. Mechanically, the car remains unchanged and is offered with the 0.8-litre petrol engine that churns out 53 bhp and 72 Nm of peak torque, while paired with a 5-speed manual gearbox. There’s also the 1.0-litre petrol motor on offer with 67 bhp and 91 Nm of peak torque, which is paired with a 5-speed manual and AMT unit.

Apart from redi-GO, the Renault Kwid is the only model in this segment to get ABS as a standard feature. Both cars are underpinned by the same CMF-A platform and produced at the Renault-Nissan manufacturing facility in Oragadam, near Chennai. The Maruti Suzuki Alto is the best-seller in this space but only gets ABS in the top trims. Visually, there are no changes made to the car, not even a badging that differentiates the manual version from the AMT. The equipment list also remains unchanged and there no exterior additions what so ever. It is based on the T(O) and S variant of the redi-GO, so you get all the top-end feature like the hexagonal grille with chrome surround, sweptback headlamps with integrated turn lights, LED daytime running light on the bumper, wheel cover, and body coloured bumpers and door handles. In fact, dimensionally the car remains unchanged so you still get the segment best and ground clearance of 185 mm, along with a total length of 3429 mm, a width of 1560 mm, and height of 1541 mm.

First impressions as you step into the cabin are pretty good. The high seats, combined with the expansive glass areas make the cabin airy. The dashboard is well designed, the plastics around the cabin are textured and the steering and gear-lever feel good to hold.

There’s a fixed air-con vent which sits atop of the central console and channels air to the rear. The adjustable AC vents on the driver and passenger side are similar to those seen on other Datsun cars. The audio system, unfortunately, isn’t a touchscreen unit like on the Renault Kwid. Instead, you get a CD and MP3 player, aux-in and USB connectivity, but there’s no Bluetooth. The instrument panel is the same unit as on its larger siblings, the Go and Go+, which includes a speedometer combined with a small orange digital display for the tachometer and trip computer which displays average mileage, fuel level, distance-to- empty and comes with a gear-shift indicator too.

In terms of storage spaces, there’s a large shelf on the passenger side, a roomy cubbyhole below the air-con controls and a smaller cubbyhole to the right of the steering wheel. You also get a cup-holder and a large bottle-holder in front of the gear lever and a flat tray under the handbrake. The small rear windscreen is also likely to create a blind spot while reversing. Datsun also claims that the Redigo comes with the best-in- class rear space and it just might be right. While knee-room is more than sufficient, the headroom is fantastic. The high ground clearance also makes getting in and out of the cabin easy while the seats, though a bit upright, are comfortable too. However, the relatively narrow width of the car makes three abreast seating a tight affair.

The Redigo gets a 222-litre boot, which isn’t the best in its segment, but is adequate. However, its high and narrow opening makes loading luggage into the boot quite a chore. There’s a plastic parcel tray, which adds a measure of convenience to the cabin. Unfortunately, it is obtrusively bolted to a supporting frame, which restricts flexibility.

For starters, Datsun has named its AMT unit ‘Smart Drive Auto’, unlike the Kwid AMT which gets Renault’s Easy-R system, but the differences are not just limited to the name. The biggest difference is that the redi-GO gets a conventional shifter. So there’s a lever instead of the rotary dial. Another key difference is the manual model, which will particularly come in handy when you want to overtake someone, or trying to go up-hill. This was one function that went missing in the Kwid. Lastly, unlike the Kwid AMT, the redi-GO’s AMT unit also gets the ‘creep’ function, which allows the car to cruise at low speeds of 5-6 kmph without you having to depress the accelerator, a smart feature to have in bumper to bumper traffic, in our opinion. In fact, Datsun has also given this a fancy name, and it calls it the ‘Rush Hour Mode’.

The Datsun redi-GO AMT gets the same 999 cc, three-cylinder petrol engine with Datsun’s i-SAT or Intelligent Spark Automated Technology. Power and torque figures also remain unchanged at 67 bhp and 91 Nm respectively. In fact, the car has been really well received in India, and Datsun says that over 30 per cent of the redi-GO sales come from the 1.0L model. Now, when we reviewed the manual version of the car, we had mentioned that the gearshifts are not seamless and lack feedback, sadly Datsun hasn’t addressed to those problems in the AMT version as well. In fact, we could hear gearshifts quite evidently. You can hear the engine rumble and it’s not quite above 3000 rpm, which points a finger to the NVH levels it has.

There was need of some low-end torque, but once you are above the 2nd gear, and have crossed the 4,000 rpm mark, power and torque gradually come into play and that’s when the redi-GO AMT is in its zone. It’s happy, peppy and fun. Of course, if you try and hurry and floor the accelerator, well, the AMT takes some time to respond and that’s a very noticeable lag. This is where the manual mode comes in handy. Shift the lever to the left and now you can toggle it up and down to downshift and upshift. In the manual mode, the car feels a little more responsive and allows you to manoeuvre more quickly. Also, if you are not in the right gear you’ll hear a continuous beeping sound with an indication on the instrument cluster.

Datsun redi GO Driving

The ride and handling of the car hasn’t changed compared to the redi-GO 1.0L manual version. The suspension is still a bit on the stiffer side, so you do feel the undulation on the road and the small thuds can be heard inside the cabin. The steering is light and it helps in city traffic conditions but doesn’t impart a lot of confidence when you are on the highway doing high speeds. The shorter turning radius is a big help when it comes to taking tight turns within the city and around traffic and just helps you squeeze out of the small alleys. You also sit tall inside the redi-GO which offers a good field of view when you are driving and even the brakes are pretty good and offer enough bite and stopping power.

The top-end variant of New Datsun Redi-GO features driver side airbags as well, which makes for a very good offer in this segment. Along with this, the car gets disc brakes at the front and drum brakes at the rear to give the driver a confident drive.As for safety, an optional driver-side airbag will be offered on the top-spec Redigo, but there will be no ABS. Also note that rear passengers only get static seatbelts, which need to be manually adjusted. Up front, the skinny seats are reasonably comfortable, and offer the driver and the front passenger a good view out. The front seats are not adjustable for height and neither is the steering for rake or reach.

We think that 2016 Datsun Redi-GO has the potential to challenge the competitors but the maintenance costs can pose a challenge. The car looks smart and different with its “tall boy” design, and is comfortable on the inside in the front seats. Let’s keep an eye on how far this takes the Datsun Redi-GO.New Datsun Redi-GO competes with the likes of Maruti Alto 800, Hyundai Eon, Renault Kwid, etc. The Datsun car is lighter and powerful than the others but in terms of features, Renault Kwid takes the cake. In terms of performance and maintenance, however, Maruti Alto 800 has been the undisputed champion. We hope to see a stir in the numbers.
